1. Scope of Application

These Terms & Conditions apply to all contracts concluded between

Deviating conditions of the User shall not be recognized unless the Provider expressly agrees to their validity in writing.

2. Service Description

BirdieTraining offers a digital training platform and mobile app for golfers.

Features include:

• Access to training exercises, statistics and evaluations
• Creation of individual training plans
• Storage of training progress
• (optional) Leaderboards and game-based competitions
• Advanced premium features within a subscription

The specific scope of services is determined by the service description valid at the time of contract conclusion on the website or in the App Store.

3. Contract Formation

The contract between the User and BirdieTraining is formed when:

• the User creates an account, or
• a paid subscription is concluded via App Store / Google Play or directly via BirdieTraining.com.

By completing the registration process or order, the User accepts these Terms & Conditions.

4. Use of the Platform

Registration:

Registration with email address and password is required to use the app.

User Obligations:

• Access credentials must not be shared with third parties.
• The User agrees not to store or distribute illegal content.
• Misuse (e.g., manipulation of training data) will result in exclusion from the platform.

Technical Requirements:

The User is responsible for a functional internet connection and a compatible device.

5. Prices and Payments

• Use of the basic version is free.
• For premium features (e.g., advanced training analysis, leaderboards, additional exercises), a paid subscription can be purchased.
• Payment is made via the respective App Store (Apple/Google) or directly via our website through recognized payment providers (e.g., Stripe, PayPal).
• All prices are inclusive of applicable statutory VAT.

6. Contract Duration and Cancellation

Free Use:

Can be terminated at any time without notice.

Paid Subscriptions:

• Subscriptions automatically renew for the respective term (e.g., monthly or annually) unless canceled at least 24 hours before expiration in the App Store or account settings.
• Upon cancellation, access remains until the end of the current billing period.
• BirdieTraining reserves the right to block or cancel access if the User violates these Terms & Conditions.

7. Right of Withdrawal

Consumers generally have a 14-day right of withdrawal for digital services.

However, the right of withdrawal expires if the User expressly agrees that the service should be provided immediately (e.g., activation of the subscription) and acknowledges losing the right of withdrawal thereby.

Detailed information about the right of withdrawal is provided during the ordering process in the App Store or on our website.

8. Liability

• The content on BirdieTraining serves as training support and does not replace individual golf consultation by a PGA professional.
• For simple negligence, the Provider is only liable for breach of essential contractual obligations (cardinal duties).
• Liability is limited to foreseeable, typical contractual damage.

9. Availability

BirdieTraining strives to enable uninterrupted use as much as possible.

However, planned maintenance work or short-term technical failures may occur without giving rise to claims against the Provider.

10. Intellectual Property

All content published on the platform (texts, videos, graphics, exercises, logos) is protected by copyright.

Any reproduction, distribution, or public performance without express consent of the Provider is prohibited.

11. Privacy

The handling of personal data is governed by our Privacy Policy.

12. Changes to Terms & Conditions

The Provider reserves the right to change these Terms & Conditions in case of changes to the legal situation, functions, or technical adjustments.

Users will be informed about significant changes in a timely manner.

13. Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR):

The Provider is not obligated and generally not willing to participate in dispute resolution proceedings before a consumer arbitration board.

14. Applicable Law

The law of the Federal Republic of Germany applies, excluding the UN Sales Convention.

Place of jurisdiction is – as far as legally permissible – Munich.
